GENERAL

In connection with the booking and for uncomplicated processing, the photographer is entitled to store and manage personal data (name, address, telephone number, etc.) accordingly.

Through the written confirmation (e-mail) of the offer sent by Livia Bass, an order is already considered firmly booked and the terms and conditions as accepted. The booked time can not be divided into two or more parts.

The price of the reportage includes professional editing, but not extensive portrait retouching (skin editing, etc.). This will be commissioned separately on request and invoiced at CHF 120. The minimum duration is half an hour. It will be charged per quarter of an hour or part thereof.

Any complaints must be reported to the photographer no later than 5 days after delivery. Subsequently, the photographic materials are considered accepted. Requests for changes that reach the photographer after these 5 days will be charged at an hourly rate of CHF 120. The minimum duration is half an hour. It will be charged per quarter hour or part thereof.

For weddings, a detailed agreement will be drawn up. All other orders will be confirmed by email.

SELECTION, DELIVERY & SECURING OF IMAGES

The number of photos to be delivered depends significantly on the individual presence time as well as the possible motives. A minimum number of photos can neither be specified nor demanded. It is at the photographer's discretion which photos are used for the reportage. On average, 30-50 usable picturesare taken per hour during a reportage. However, this number can vary up or down due to various factors (e.g. program points, number of guests, location, etc.).

The pictures are delivered in JPEG format and in high resolution in an online gallery. The images can be downloaded in 2 sizes (highsize & websize) directly from the online gallery. The delivery of unprocessed, digital raw data (RAW) is excluded.

After receiving the images, the client is solely responsible for the proper storage and security of the files.

It is recommended to back up the photographic material on at least one additional data carrier.

Livia Bass backs up the delivered photos for a maximum of 2 years after the photo session, during which time data carriers and individual photos can be reordered for a fee.

The storage of the digital image data is not part of the order. The photographer assures to keep the final photos for the duration of 12 months, after that no claims can be made. The online gallery will remain available for 6 months.

RIGHTS OF USE & COPYRIGHT

The client is entitled to use the resulting photographs for private purposes (social media, print, own website, etc.) without any restrictions in time, place or content.

The images are subject to copyright, further processing of the images (including overlaying filters, Facetune, etc.) is not permitted.

The photographer is entitled to use selected images of the photo reportage for self-promotion purposes (print, Internet) and to show them as a reference. The selection will be shownto the customer via online gallery before publication. If the customer does not want certain photos to be shown, they are to be hidden using the corresponding function in the online gallery.

A transfer to third parties (service providers, blogs, etc.) mayonly take place after written consent of both parties (photographer & customer). The photographer is always and without exception to be marked when publishing the images (Instagram, Facebook), or where not possible, to be named with the website (www.liviabass.com). Please tell all so, should the images be forwarded by the customer to third parties.

The right of use will not transfer to the client until all outstanding invoices have been paid in full.

Livia Bass Photography, as the copyright holder, is granted the right to use selected images free of charge for promotional purposes, e.g. websites, business cards, price lists, flyers, brochures, contests, advertisements, websites, social networks (Facebook, Instagram, etc.) sedcards, etc.... Livia Bass Photography has the right, especially in publications (Internet, print media), exhibitions, advertising, conversations and presentations with potential clients, to refer to the cooperation with the client and the photographic work created for him and to provide references.

At events / weddings or other occasions, the client / bride and groom must obtain the consent of the persons present, pictured, respectively their legal guardians or guardians and is solely liable for this.

ADVANCE FEE, COSTS & INVOICE

Additional attendance hours of the photographer can be added in advance or on the day of the shoot (depending on capacity) if needed. The price depends on the booked package. Billing is per quarter hour or part thereof. The invoice for the additional hourswill be issued by mail after the order.

Travel costs are included from 8005 Zurich up to 10 km -additional driven km will be charged with CHF 0.80/km.

The remaining amount with the possible additional costs (e.g. travel expenses) will be charged with the final invoice after the order.

WEDDING

With the signing of the contract, 50% of the agreed cost of the package is due to make the reservation binding. Without this reservation fee, the date is not blocked and the date will be released by the photographer for other couples after this period. The fee advance is a non- refundable fee. If the assignment is cancelled, it will be retained for work already done (meetings, preparations, research, etc.). The fee advance is non-transferable to other products ofthe photographer.

CANCELLATION & RESCHEDULING

Cancellations must be made by phone or in writing (e-mail).

Verschiebt der Auftraggeber den Auftragstermin weniger als 3 Tage vor seinem Termin, so hat Livia Bass Photography Anspruch auf die ihr bereits angefallenen Kosten. Zusätzliche Aufwände werden auch verrechnet.

Exceptions apply in the summer for agreed appointments depending on weather conditions. For such dates a reserve date will be arranged in advance.

WEDDING

If the wedding date changes and the photographer is unable to attend the new date, the bride and groom will also lose the advance fee.

If the order is cancelled less than 2 months before the wedding date, the full amount will be due.

If the cancellation is made by the client due to cancellation of the event because of demonstrable serious illness or death of the bride and groom, the amount of compensation is at the sole discretion of the photographer.

HIGHER FORCE

If the Photographer is unable to complete the order or deliver the images within the deadline due to force majeure (accident, loss/defect of equipment, malfunction of technology, etc.), the Client waives the right to claim compensation or to pass on any additional costs incurred to the Photographer.

VOUCHERS

Purchased gift certificates are valid for 1 year from the date of issue.

After one year, the current price for the booked shooting by Livia Bass will apply.

The differencein the increase will be charged to the client.

The order confirmations and contracts concluded with Livia Bass Photography are subject to Swiss law.

All changes and amendments concerning the GTC must be made in writing.

Livia Bass Photography reserves the right to change or amend the general terms and conditions at any time.

The GTC are subject to Swiss law. The place of jurisdiction is the place of residence of the photographer.

These GTC are valid as of February 21, 2022.
